Information you provide
When you book a call, sign up, or contact us, we collect details such as your name, business name, email address, phone number, role, and any information you submit through forms or messages.
Lead data you upload
To deliver our services, you may import or connect a CRM containing contact records for your leads (names, phone numbers, email addresses, prior interaction history, and similar fields). You remain the controller of that data; we process it on your behalf as a service provider.
Usage and device data
We automatically collect technical information when you visit our site or use the platform: IP address, browser type, device identifiers, pages viewed, referring URLs, and timestamps. This is collected through cookies, server logs, and similar technologies.
Communications
If you exchange messages with us — by email, SMS, or through our platform — we retain a record of those communications.

- To deliver SMS campaigns on your behalf and report on their performance.
- To authenticate users, prevent fraud, and secure our systems.
- To respond to inquiries, provide support, and send service-related notices.
- To send marketing communications about our own products (you can opt out at any time).
- To comply with legal obligations and enforce our agreements.
03Cookies & Tracking
We use cookies and similar technologies for essential site functionality, analytics, and measuring marketing performance. We use Google Tag Manager and analytics tools to understand how visitors interact with our site. You can control cookies through your browser settings; disabling them may affect parts of the site.
04How We Share Information
We do not sell personal information. We share information only in these circumstances:
- Service providers. Hosting, database, analytics, email, and SMS-delivery vendors who process data on our behalf under written agreements.
- Telecom carriers. To deliver SMS messages, we transmit message content and recipient phone numbers to messaging aggregators and carriers.
- Your direction. When you connect a third-party CRM or tool, data flows according to the integration you authorize.
- Legal & safety. When required by law, subpoena, or to protect rights, property, or safety.
- Business transfers. If we are involved in a merger, acquisition, or asset sale, your information may be transferred as part of that transaction.
05SMS & TCPA Compliance
SMS Genie is designed for sending messages to leads who have given prior express consent to be contacted. As our customer, you are responsible for obtaining and maintaining the consents required under the Telephone Consumer Protection Act (TCPA), CAN-SPAM, A2P 10DLC registration requirements, and any other applicable laws. We honor opt-out requests (STOP, UNSUBSCRIBE, etc.) and maintain suppression lists. Mobile information collected through our SMS programs is used only for delivering the messages you've authorized and is not shared with third parties for their marketing purposes.
06Data Retention
We retain personal information for as long as your account is active and as needed to provide services. After termination, we may retain data for a limited period to comply with legal obligations, resolve disputes, and enforce agreements. Upon written request, we will delete or return customer-controlled data subject to applicable retention requirements.
07Security
We use administrative, technical, and physical safeguards designed to protect personal information — including encryption in transit, access controls, and ongoing monitoring. No system is perfectly secure, and we cannot guarantee absolute security.
08Your Rights
Depending on where you live, you may have the right to access, correct, delete, or port your personal information, to object to or restrict certain processing, and to withdraw consent. California residents have additional rights under the CCPA/CPRA, including the right to know what personal information we collect and to opt out of certain sharing. 09Children
SMS Genie is not directed to children under 16, and we do not knowingly collect personal information from children. If you believe a child has provided us with personal information, contact us and we will delete it.
10International Transfers
We are based in the United States and process data there and in other countries where our service providers operate. If you are outside the U.S., your information will be transferred to and processed in jurisdictions that may have data-protection laws different from your own.
11Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we'll revise the "Last updated" date above. Material changes will be communicated through the platform or by email.
